INSTITUTE CARGO CLAUSES (A), (AIR), (B) and (C)
EXCLUDE LOSS, DAMAGE OR EXPENSE CAUSED BY:
Exclusions
- Wilful misconduct of the assured
- Ordinary leakage, Ordinary loss in weight or volume, Ordinary wear and tear
- Insufficiency or unsuitability of packing or preparation of the cargo or improper stowage in containerswhen carried out prior to attachment of cover by the insured.
- Inherent vice or the nature of the cargo.
- Delay (even though the delay could be caused by a risk insured against)
- Insolvency or financial default of the owners / managers / charterers / operators of vessel. - ( aircraft in the case of ICC(AIR) )
- Nuclear or atomic weapons
- Unseaworthiness of vessel or craft or unfitness of the vessel/craft/container weher the insured is privy to such at the time te cargo is loaded therein.
In addition to these general exclusions all of these Institute Clauses exclude War and Strikes (including Terrorism). These can normally be added back in on payment of an additional premium and subject to the application of the appropriate Institute Clauses providing for War and Strikes risks.
Exclusions in the ICC (B) and (C) but not in (A) OR (AIR)
- Damage or deliberate destruction of all or part of the cargo by the wrongful act of any person(s)*
* This exclusion can be bought back by the inclusion of the Institute Malicious Damage Clause
